“Para la solución de cuantas controversias pudieran derivarse del presente contrato o estuvieran con él relacionadas, incluida cualquier cuestión relativa a su existencia, validez, interpretación, ejecución o terminación, las partes acuerdan y se comprometen a someterlas al Centro de Mediación Empresarial de Madrid de la Cámara Comercio de Madrid, conforme a su Reglamento vigente a la fecha de presentación de la solicitud de mediación, por un mediador nombrado conforme al mismo.

 

Opcional:

- Las partes podrán optar por más de un mediador.

- El lugar de celebración del procedimiento será […].

- El idioma del procedimiento será […].

 

A falta de resolución de las controversias según dicho Reglamento dentro de los 60* días siguientes a contar desde la admisión a trámite por el Centro de la solicitud de mediación, o al vencimiento de otro plazo que así hubiera sido estipulado expresamente por las partes, tales controversias serán resueltas definitivamente mediante arbitraje administrado por la Corte de Arbitraje de la Cámara de Comercio de Madrid de acuerdo a su Reglamento vigente a la fecha de presentación de la solicitud de arbitraje. El arbitraje será resuelto por árbitro único**”.

* Las partes podrán pactar un plazo mayor o menor de 60 días para la mediación.

“The parties agree to submit to the Business Mediation Center of the Madrid Chamber of Commerce any dispute arising out of or relating to this contract, including any matter regarding its existence, validity interpretation, compliance or termination. The mediation will be conducted in accordance with the Center’s Rules in force at the time the request for mediation is filed, by a mediator appointed following those Rules.

 

Optional:

- The parties may opt for more than one mediator.

- The place of the mediation shall be […].

In the event that the dispute is not solved pursuant to the Rules within 60* days following the admission of the mediation request by the Center, or within any other time limit expressly set by the parties, such dispute shall be definitively settled by arbitration administered by the Court of Arbitration of the Madrid Chamber of Commerce, in accordance with its Arbitration Rules in force at the time the request for arbitration is filed. The arbitral tribunal appointed for such purpose will be formed by a sole arbitrator**”.
